DEYLON SARL TERMS & CONDITIONS



Preamble

This site is in its totality the exclusive property of DEYLON SARL (DEYLON), as well as the associated rights. Reproduction in whole or in part, is subject to authorisation from the site owners. However, the connections of the type hypertexts towards the site are authorized without specific demand.

1. Acceptance of the Terms and Conditions

The customer admits having taken knowledge, at the time of the placing of order, of the particular conditions of sales displayed on this screen and expressly declares to accept them without reserve. These general terms and conditions govern the legal relationship between DEYLON and its customer, both parts accepting them without reserve. These terms and conditions shall prevail over any other terms contained to any other documents, except preliminary objection, express and written.

2. Products

The photographs illustrating the products, do not enter the contractual field. DEYLON can under no circumstances be held liable if errors were introduced there.

3. Order

The systems of automatic booking are considered as evidence of the nature, content and date of an order. DEYLON confirms acceptance of a customer order at the email address which this one will have communicated. Sales will be effective only after the confirmation of the order. DEYLON reserves the right to cancel any order of a customer with whom there would be a litigation relating to the payment of a former order. In case of error in the delivery information given by the customer, DEYLON could not be held responsible for failure in delivery.

4. Shipments

Following order confirmation, DEYLON undertakes to deliver to its carrier all the items ordered by the customer within a maximum period of three working days.
All orders placed with DEYLON are intended for the personal use of customers and customers or recipients of products are forbidden to resell all or any of the products. DEYLON frees itself as a matter of a fact from legal liability if the payment of tariffs is not made by the customer. Delivery to the customer being undertaken by a carrier, either case of absence, DEYLON is not able to guarantee  the exact time of delivery. Any delay in shipping the products shall not entitle the customer to claim for damages/financial compensation. In the case of a technical product, the customer shall pay special  attention for ensuring that the delivered product operates correctly and reading the manual supplied. In the event of apparent defects, the customer is granted the right to return under the conditions specified in this document. The following shall be considered events due to circumstances beyond one’s control releasing DEYLON from its obligation to deliver : war, riot, fire, strike, accidents, inability to obtain supply. Goods always travel at the customer own risk. The customer shall have a period of forty-eight hours to make any eventual reserve to the carrier in case of failure or damage. For availability concerns, an order can be dispatched in several shipments. Then the customer shall only pay for a single delivery.

5. Withdrawal

The customer has a fourteen days period as from the reception of the products to form an opinion on the matter. In case of exchange or refund, the item(s) must be returned in the original packaging, intact, together with their accessories, instruction guides and documentations to the following address:

In case of exercise of right of withdrawal, DEYLON is liable to refund the sums paid by the customer at the time of placing its order. The customer cannot claim any further compensation. Reimbursement will take place within a maximum fifteen opening days period.

6. Pricing

The price is expressed in euro. The price indicated on product sheets does not include the transport. The price listed in the order confirmation is the final price, all taxes included. The price comprises the price of the product, the handling charges, packaging and conservation of the product, the shipping charges and commissioning.

7. Payment

The price invoiced to the customer is the price indicated upon order confirmation addressed to the customer by DEYLON. The price of product is payable cash on the effective date of order. Payment is made by credit card carrying initials CB. On line payment services provider Paypal (by CB or Paypal account) enables to make payments via a banking server in a secure environment. The customer’s credit card number goes through the servers of the bank, the payment is made directly to a bank in a secure environment without going through the server of the store, all the more a guarantee because the card number is only known by the bank partner of DEYLON. The order validated by the customer will only be considered as effective once approved by the relevant banking institutions. Refusal of these centres will automatically cause the cancellation of the order and the customer will be notified by email. Moreover, DEYLON reserves its rights to refuse any order  from a customer with whom there is a litigation.

8. Litigation

This contract is subject to French law. DEYLON cannot be responsible for any material or immaterial or corporal damage resulting from a poor functioning or from a misuse of the marketed products. The same applies for the possible changes made by the manufacturers of the products. The liability of DEYLON will be, in any event, limited to the amount of the order and shall not be assumed for simple errors or omissions that may have subsisted despite precautions taken in the presentation of the products. In case of difficulties in the application of the present contract, the customer shall, prior to any legal action, seek with DEYLON an settlement possibly with the help: of a professional association of the branch, of a consumer organisation or any other form of counselling of its choice. It is called back that the search of a settlement does not interrupt the " short delay " of the legal guarantee, nor the duration of the contractual guarantee. It is reminded that as a general rule and subject to the appreciation of the Courts, the respect of the clauses of the present contract relative to the contractual guarantee supposes that the buyer honours its financial commitment to the vendor. Otherwise, the Paris Court is the only competent court, regardless of the location of the delivery and the accepted methods of payments.

9. Warranty

DEYLON guarantees that all selected products are manufactured or produced in the countries specified in the datasheets or falling that, to the packaging. The expiration dates of the product must be respected by the customer. In any case DEYLON cannot be responsible for the non-respect of the existing prescribed and legal arrangements, the liability of DEYLON is systematically limited to the value at its date of sale of the blamed product, and this without possibility of recourse towards  the mark or the producing company of the product. In any assumption, the customer benefits from the legal warranty of eviction and hidden defect (Art.1625 and following of Civil Code). On the understanding that the buyer demonstrates evidence of hidden defect, the vendor must legally repair all the consequences (art.1641 and following of Civil Code); if the buyer takes the case to court, it does so with a " short delay " after discovery of hidden defect (art.1648 of Civil Code). 10. Legal notices

Intelligence information collected for the purposes of distance selling is required since such information is necessary for processing and delivering orders, drawing invoices and guarantee agreements. Failure to comply with providing proper information implies the non validity of the order. In accordance with the " Informatique et Libertés " Law of 6th January 1978, processing nominative informations relative to customers has been the subject of a declaration to the French Data Protection Authority (CNIL). The customer lays out according to the article 34 of the Law of  6th January 1978 of the right at any time to access, to modify, to correct and to delete their personal data. Moreover, DEYLON is committed not to divulge to third parties any personal information that customers provide.
